Fall Decorating Terms & Agreement

By submitting this booking request, I acknowledge and agree to the following terms and conditions:

1. Booking Requests & Confirmation

I understand that submitting this form is a booking request and does not guarantee a decorating date until the booking has been reviewed and confirmed by Broad Creek Farms.

Decorating dates are subject to availability. Broad Creek Farms will contact me to confirm my decorating date and any applicable delivery, decorating, removal, or payment details.

2. Delivery

Delivery is complimentary within a 20-mile radius of Broad Creek Farms.

A $30 delivery fee applies to locations more than 20 miles and up to 50 miles from the farm.

Locations more than 50 miles from the farm require special arrangements and may be subject to additional fees.

3. Cancellations

No cancellations are permitted within 72 hours of the scheduled delivery/decorating date.

Cancellations made more than 72 hours before the scheduled delivery may be subject to the terms communicated at the time of booking.

4. Live, Seasonal & Perishable Products

I understand that pumpkins, gourds, trees, straw, flowers, and other natural decorating materials are live, seasonal, and/or perishable products.

Because of the natural and seasonal nature of these products, all sales are final and no returns are accepted.

Natural products may vary in size, shape, color, texture, and appearance. Items may naturally change over time due to weather, temperature, moisture, insects, animals, and other environmental conditions.

If I experience an issue with my order, I agree to contact Broad Creek Farms within 24 hours of delivery so the concern can be reviewed.

5. Porch Surface Disclaimer

Broad Creek Farms takes great care in arranging pumpkins, trees, straw, and other décor beautifully and safely. However, by purchasing a decorating package, I acknowledge that natural decorating materials may contain moisture, dirt, sap, plant material, or other natural elements.

I understand and agree that Broad Creek Farms is not responsible for staining, rotting, moisture damage, insect attraction, discoloration, or surface wear that may occur to my porch, steps, siding, flooring, concrete, wood, stone, or other surfaces as a result of the natural properties of pumpkins, gourds, trees, straw, or other decorating elements.

To minimize potential risk, Broad Creek Farms recommends:

• Placing décor on non-porous surfaces whenever possible.

• Using trays, mats, or other protective barriers under items when appropriate.

• Keeping décor away from areas where standing water may accumulate.

• Removing pumpkins and other natural products once they begin to soften, deteriorate, or show signs of decay.

I understand that outdoor environmental conditions are beyond the control of Broad Creek Farms and that natural products will change over time.

6. Product Condition & Natural Deterioration

I understand that pumpkins and other natural products are living or perishable materials and may naturally deteriorate during the season.

Weather, temperature, sunlight, moisture, insects, wildlife, handling, and other environmental factors can affect the appearance and lifespan of the products.

Broad Creek Farms is not responsible for natural deterioration or damage caused by weather, animals, insects, or other environmental conditions after delivery.

7. Customer Responsibility

Once the display has been delivered and arranged, the customer is responsible for reasonable care of the display and for protecting the surfaces where the décor is placed.

The customer agrees not to move, stack, alter, or rearrange the display in a manner that could cause damage to the property or décor.

8. Pumpkin Removal

If pumpkin removal is selected as part of the booking, Broad Creek Farms will coordinate removal during the selected November removal week.

If removal is not selected, the customer is responsible for removing the display and disposing of or otherwise handling the natural products.

9. Payment

I agree to pay all applicable charges associated with my selected decorating service, including the decorating package, delivery fees, removal fees, or other charges communicated by Broad Creek Farms.

A booking is not considered fully confirmed until any required payment or deposit has been received and the booking has been confirmed by Broad Creek Farms.

10. Agreement

By checking the agreement box and submitting this form, I confirm that:

• I have read and understand these Terms & Agreement.

• I understand that this form is a booking request, not a guaranteed decorating appointment.

• I understand that my booking is not confirmed until Broad Creek Farms confirms it.

• I understand the delivery and applicable fee structure.

• I understand the 72-hour cancellation policy.

• I understand that all sales are final and no returns are accepted due to the seasonal and perishable nature of the products.

• I understand and accept the Porch Surface Disclaimer.

• I understand that natural products may deteriorate or change due to environmental conditions.

• I agree to the applicable decorating, delivery, removal, and payment terms.

11. Photography & Marketing Permission

By purchasing a decorating package from Broad Creek Farms, I acknowledge and agree that Broad Creek Farms may photograph or video the completed decorating display, including the porch, property exterior, pumpkins, décor, and overall arrangement.

I grant Broad Creek Farms permission to use these photographs and videos for marketing and promotional purposes, including but not limited to the Broad Creek Farms website, social media accounts, advertisements, promotional materials, and other business-related communications.

Broad Creek Farms will make reasonable efforts to avoid including identifiable personal information, individuals, license plates, or other private information in marketing materials.

I understand that I will not receive compensation for the use of these photographs or videos and that Broad Creek Farms retains the right to use the images for promotional purposes.

By submitting this form, I acknowledge that I have had the opportunity to review these terms and agree to be bound by them.
